SCOTUS Wants to Counsel the Counselors and Bondi Wants to Counsel the Criminals.
The Supreme Court opened its fall term this week with enough constitutional chaos to keep every civil rights lawyer awake until November.
First up: Chiles v. Salazar — Colorado’s ban on conversion therapy for minors is under attack. SCOTUS will decide whether a therapist’s “right to free speech” includes the right to psychologically torture queer kids. The state argues it’s regulating conduct, not speech. Then comes Barrett v. United States, a double jeopardy case asking whether someone can be punished twice for the same gun-related act under overlapping federal statutes. Add to that Wolford v. Lopez, where Hawaii’s limits on carrying guns in public are being challenged, and the Court’s upcoming review of Executive Order 14160, Trump’s unconstitutional assault on birthright citizenship. Meanwhile, Attorney General Pam Bondi is testifying in her first oversight hearing before the Senate Judiciary Committee. If SCOTUS strikes down the conversion therapy ban, it will set a national precedent allowing hate under the banner of “religious liberty.”
If they expand double jeopardy punishments, it will strengthen a carceral system already rigged for political use.
If Bondi’s DOJ goes unchecked, Trump’s revenge tour becomes policy.
They’re normalizing cruelty through process — weaponizing the courts to rewrite what justice means.
